Terms of Service

These Terms of Service ("Terms") govern your use of the Esoora Express application operated by Ethio Clicks PLC. By accessing or using our App to order delivery services, you agree to be bound by these Terms.

1. User Accounts

When you create an account with us, you represent and warrant that all personal contact information and addresses you provide are accurate, complete, and current at all times. You are responsible for safeguarding your login credentials (such as your password and phone text verification codes) and for any activities or actions under your account.

2. Using the Service

Placing Orders: You may use the App to request the pickup and delivery of packages. You are responsible for ensuring that the pickup and drop-off coordinates or addresses provided are accurate.

Prohibited Items: You agree NOT to use Esoora Express to send illegal, hazardous, explicitly dangerous, highly fragile (without proper packaging), or heavily regulated items (such as unprescribed narcotics or illegal weapons). Our delivery agents reserve the right to refuse pickup if the package is deemed unsafe or violates these terms.

3. Payments and Delivery Fees

By placing an order, you agree to pay the delivery fees calculated and displayed to you in the App before confirming your order. Fees are based on distance, vehicle type, and current demand. Payments must be settled according to the payment methods supported within the application (e.g., Cash on Delivery or digital payment integrations).

4. Cancellations and Refunds

You may cancel an order through the App. If you cancel an order after an agent has already been dispatched and arrived at the pickup location, a cancellation fee may apply to compensate the agent for their time and travel. If a delivery cannot be completed due to incorrect address details provided by you or an unreachable recipient, the item may be returned to the pickup location at your expense.

5. Prohibited Uses

You may not use the Service for any unlawful purpose or to solicit others to perform or participate in any unlawful acts. You agree not to abuse, harass, or harm any other person, including our delivery agents or our support staff. Any attempt to fraudulently claim missing items or exploit the app is strictly prohibited and can result in account termination.

6. Limitation of Liability

In no event shall Ethio Clicks PLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ethiopia, without regard to its conflict of law provisions.
